By accessing or using YAP ("the Platform", "we", "us", "our") at yaphub.xyz or any embedded Widget, you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately stop using the Platform.
These Terms constitute a legally binding agreement between you and the operator of YAP. If you are using the Widget embedded on a third-party website ("Integrating Platform"), these Terms apply to your use of the Widget regardless of where it is embedded.
By making any payment on the Platform — including but not limited to Premium membership or Token Profile Upgrades — you expressly agree to the payment terms set out in §11–§14 of these Terms.
YAP is an anonymous, user-generated content platform that provides:
You must be at least 16 years of age to use YAP, in accordance with Article 8 of the EU General Data Protection Regulation (GDPR) as implemented in German law.
If you are under 16, you are not permitted to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement.
For users under 18, parental or guardian consent may be required in your jurisdiction for any paid features or purchases. YAP reserves the right to refuse service to any user who cannot demonstrate compliance with applicable age requirements.
All content on the Platform, including chat messages, sentiment votes, leaderboard rankings, token profile information, and promoted content, is user-generated and represents the personal opinions of anonymous third-party users only.
Token Profile Upgrades are purely cosmetic display enhancements. A token's appearance on the Platform — including its name, logo, or community links — does not constitute any endorsement, verification, or recommendation by YAP.

The Platform explicitly prohibits the use of its chat, sentiment voting, Token Profile Upgrades, or any other feature to artificially inflate or deflate the perceived value of any cryptocurrency, coordinate buying or selling activity, spread knowingly false information to influence token prices, or create a false impression of community sentiment.
YAP operates as a hosting service provider within the meaning of Article 6 of the EU Digital Services Act (DSA, Regulation 2022/2065) and the EU e-Commerce Directive.

If you operate a website that embeds the YAP Widget ("Integrating Platform"), you agree that:
User Content: All messages and content posted by users remain the intellectual property of the respective user. By posting content, users grant YAP a non-exclusive, royalty-free, worldwide licence to display and process such content solely for the purpose of operating the Platform.
Token Profile Data: Token names, logos, and metadata displayed via Token Profile Upgrades are sourced from public blockchain data or submitted by the paying user. YAP does not claim ownership of any token branding. The paying user warrants that they have the right to use any submitted or linked content.
Platform Content: The YAP platform, including its design, code, and branding, is the intellectual property of YAP. Unauthorised reproduction is prohibited.
Content Removal: Messages automatically expire after 24 hours. Token Profile Upgrades remain active for their purchased duration. YAP reserves the right to remove any content at any time without notice where it violates these Terms.
YAP offers an optional paid Premium membership tier linked to a YapID account ("Premium"). Premium provides access to additional features not available to free users. Current Premium features are described on the Platform and may change over time.
Activation: Premium is activated immediately upon successful payment confirmation from the payment processor. Access is granted to the YapID account used at the time of purchase.
Duration: Premium is purchased for a defined period (e.g. monthly or annual). It does not auto-renew unless explicitly stated at the point of purchase. If auto-renewal is offered, you will be notified in advance and can cancel before the renewal date.
YapID Requirement: A Premium membership is tied to a single YapID identity. If you lose access to your YapID (see §15), your Premium entitlements cannot be transferred or recovered.
YAP offers an optional paid service called the Token Profile Upgrade. This is a purely cosmetic enhancement to how a token is displayed within YAP and embedded Widgets.
What the Token Profile Upgrade includes:
No Verification of Ownership: YAP does not verify whether the purchaser is affiliated with or authorised to represent the token project. By purchasing a Token Profile Upgrade, you warrant that you have the right to submit the associated name, logo, and social links, and that doing so does not infringe any third-party rights.
Content Responsibility: You are solely responsible for the accuracy of any information submitted as part of the Token Profile Upgrade, including social media links. YAP reserves the right to remove or suspend a Token Profile Upgrade without refund if the content violates these Terms, is found to be fraudulent, or is the subject of a valid third-party complaint.
Activation: The upgrade is applied to the token's display immediately or within a reasonable time after successful payment confirmation.
All payments on the Platform are processed by Helio, a third-party cryptocurrency payment processor. By making a payment, you agree to Helio's terms of service and privacy policy, available at hel.io.

YAP is not responsible for delays, failures, or losses arising from blockchain network congestion, Helio downtime, or incorrect wallet addresses provided by the user.
EU Right of Withdrawal — Waiver: Under EU Directive 2011/83/EU (Consumer Rights Directive), consumers have a 14-day right of withdrawal for distance contracts. However, Article 16(m) of that Directive provides that this right does not apply to digital content that has been fully performed with the consumer's prior express consent and acknowledgement that the right of withdrawal is thereby lost.

YapID is a self-sovereign anonymous identity system. Your identity is derived from a 12-word BIP39 passphrase generated locally in your browser. YAP does not store your passphrase, private key, or any information that would allow recovery of your identity.

YAP reserves the right to suspend or permanently ban any user or IP address from the Platform at its sole discretion, including where a user violates these Terms.

YAP operates an automated and human-assisted moderation system. The Platform uses a three-strike system to address repeated violations:
Users may report messages using the report function built into every message. Reports are reviewed by YAP's moderation team. Frivolous or malicious reports that abuse the reporting system may themselves result in sanctions.
Moderation decisions are made at YAP's sole discretion. YAP does not guarantee a response time for moderation actions and is not liable for any content that remains visible prior to removal.
YAP uses browser-based storage technologies to operate the Platform. These include:

YAP does not use tracking cookies, advertising cookies, or any third-party analytics SDKs. No data stored locally is transmitted to third parties except as required to operate the Platform (e.g. WebSocket server communication).
You can clear all local data at any time through your browser settings. Doing so will log you out of any active YapID session.

YAP reserves the right to update or modify these Terms at any time. When changes are made:
Changes to pricing for future purchases take effect immediately upon posting. They do not affect active paid periods already purchased before the change.
These Terms are governed by the laws of Germany, without regard to conflict of law provisions. Any disputes shall be resolved by the competent courts of Celle, Germany.
